Older model BMW's with Takata air bags are dangerous according to BMW.

I've cut and pasted the body of the article, not sure if it's all there but you'll get the idea.

BMW tells owners of older models to stop driving
The German automaker is cautioning its customers that cars from the early 2000s fitted with Takata airbags are dangerous

BMW early May upgraded a recall on several of its older models to an immediate do-not-drive order, due to the danger posed by those cars’ Takata airbags. Despite having repeatedly notified owners for the past several years using a variety of methods, the German automaker says there still remain roughly 90,000 examples of its vehicles from the early 2000s in North America that have not had the inflators in their driver’s airbags repaired, making them dangerous since, in the event of a collision where the airbags deploy, those inflators could send metal shrapnel toward the occupants.

The specific models affected include the 2000 through 2006 BMW 3 Series (E46), including the M3; the 2000 to 2003 5 Series (E39), including M5; and the 2000 through 2004 X5 (E53) SUV. “These vehicles have already been included in several Takata-related recalls; however, despite intense customer outreach efforts by BMW since 2016, they remain unrepaired and, as the airbag inflators age further, the risk of serious injury or death increases,” BMW said in a release.

The automaker goes on to explain those outreach efforts have included “phone, text, email, letters and postcards, and social media,” means which have mostly worked to get hundreds of thousands of owners to have their BMWs’ airbags repaired, free of charge. It estimates about 87 per cent of BMWs with the defective parts have been fixed to date.

BMW says there is nothing preventing owners from having their cars repaired, as all the needed parts are readily available, and the fix is free; mechanics can even correct the airbag problem by performing the work remotely and coming to the owner, so that they don’t have to risk driving the vehicle to the dealer.

The German automaker is far from the only automaker with faulty Takata inflators in its older vehicles, trying desperately to fix the cars that have yet to be repaired. In February, Honda sent out a similar do-not-drive order to owners of its cars from the early 2000s; and Stellantis did the same in November 2022.

I think you're missing the point. I had this recall done on four of my cars years ago. It is those who ignored or weren't aware of the recall that this most recent notice is for. If you've had the repair, don't worry. If you still need to have it done, just do it. It takes less than an hour and costs you nothing.

The only reason they've included all E39 is because with all the steering wheel switching they can't tell which one you've got until they look at it. The airbag in the 2001-2003 E39 M-sport wheel is the one that needs replacing. Same airbag as the E9x and E8x.

Just do it.

I think this is correct. I could not take possession of my 135is (it was CPO, not new) until they did the recall.

Or don’t….and if you end up being one of the unlucky ones, oh well.

A BMW dealer is not allowed to sell a BMW under a recall. Period. New, used, CPO, no difference.

This is for the whole different reason. Don’t matter what type of reason. Dealership cannot sell a car with active recall. There are instances in which brand new cars cannot leave the lots because telhey have active recalls and those can’t be sold as well.

My recall was for the airbag.

You wasn’t allowed to take possession of the vehicle because of an active recall. If there’s any recall factory dealership will not allow you to take possession of the car.
