I think it is the cost of federalization that deters BMW from presenting that option to us. That being said I do agree with your idea. I would take it a small step further and make it a European Delivery only option, if BMW is worried about people backing out of the deal. I think I have mentioned it before if I were BMW I would make all options (Cloth seats, Individual Colors, M3 GTS, etc...) available to one of my largest markets (North America) just require non-refundable deposits and European Delivery.
