How do you know he was "no threat", that would be for a court of competent jurisdiction to decide if charges were laid. Since none of us were there the best we can do is armchair quarterback. Given my experience though a good lawyer can do a lot of damage to a prosecution especially since the behaviour that led up to this doesn't put the deceased in a very good light. Just my two cents though.
