and where did you buy the car, im assuming not from a BMW store?
and make the selling dealer aware of the problems you are incurring with the warranty issues, see if hes willing to compensate.
If all else fails then call BMW customer service and escalate it to BMW NA... but for now sit tight and wait for that magic call
