Legal Question...

Say you were to be in possession of a pet gorilla...
Say this gorilla was trained to fire a gun...

If said gorilla was to fire a gun and maim or kill an individual.... could you be held responsible?

Hard to say. . . is the gorilla a blood relative, or are you merely related by marriage? Did you provide the firearm, or did the gorilla purchase it on its own? What else have you trained the gorilla to do? Have you been tested for any bloodborne pathogens lately? Do you like gladiator movies? Is this a mountain or forest gorilla? Does it have any new information on Dian Fossey? How do you feel about Turkish baths? Are you talking about gorillas, or guerrillas? Is the individual to be maimed or killed needin' maimin' or killin'? Are you deemed sane enough to be held responsible for anything at all?

I know, it happened in CT, it was on the news for months.

But for the OP, the trainer would be responsible. It is akin to showing a 5 yr old how to handle a gun and encouraging him to shoot someone. You as the trainer are still responsible.

My answer to OP: it depends on whether the gorilla was trained to use the gun in a reasonably safe manner. No different than if you were a firearms trainer, and you gave a class on firearm usage. Now, of course there may be laws on whether a firearms trainer is allowed to train an individual (person or animal) who was mentally incompetent, so a court may decide that it was negligent/illegal to even train such a person/animal in the first place.

Now, if the gorilla did not demonstrate minimum proficiency to use the gun in a reasonably safe manner, but you still equipped the gorilla with a gun, then I think you would be responsible, not as a negligent trainer, but as a negligent/illegal provider of firearms. No different than giving/selling a gun to someone who wasn't licensed to use the gun.
