Received sewer lien on a property....WTF?

Anyone ever come across this?

Its a condo in a condo complex, today received a $20,500 bill for some Sewer Lien, which I can only image is a mistake. Unfortunately all offices are closed today and its a nice weekend headache...

I assume you have a HOA? I would bring it up with them. At least where I live I'm essentially responsible for everything inside the exterior paint. Sewer, water, and electrical lines are all within the responsibility of the HOA unless it's internal to my condo.

Unfortunately it may be correct. Did the city you live in complete a sewer upgrade or expansion that your property benefited from? If you did then you do owe, even if you weren't told it was going to happen or agree to.

However you won't owe it all up front, instead it should be broken down over X number of years either on taxes or the water/sewer bill. This is the reason why I fought for this not to happen where I live. The fairly simple expansion would have added $300+ per month to taxes in an area that couldn't sustain the extra cost.

Just throwing it out there that it may be true...

Call your city, and tell them that since you're dead you'll be unable to pay this bill.

You really need to thoroughly read your HOA declaration of covenants especially as it pertains to homeowner maintenance responsibilities. If the sewer line is considered an exclusive use common area meaning that is only used by your unit, you may be on the hook. But once again it really depends on the HOA documents.

I would also contact a member of your HOA Board for additional clarification.

I don't know how it works in other places but here the water bill is where they bill you for sewer and garbage pickup and all that. When I moved into my house I got some crazy water bill like $5000 or something. Had to go in person to the utilities office but they took care of it there and just removed the charge.

I pay this on my home. Everyone was septic, the town added sewer. We pay for the linear frontage of our property. $20k is less than what mine was.

Just an FYI, condo law is a different ballgame driven by the HOA Covenants and local ordinances. The DC & CCR’s are written by lawyers and can be confusing to pore through.

If I recall, Boston is a pretty highly regulated (and pricey) city that does look to protect apartment and condo dwellers (my son went to BC).

Good luck,

Dave

I have no clue what city did or not, I never heard about any of this. This is a condo so sewer is common. The bill is also not broken up, just says $21k is due next month (20k assessment + 500 interest + 500 taxes)

Also what the fcuk do people pay taxes for? Isnt that to cover all the maintenance. My taxes go up every year......

Take this seriously but if no one else received the notice it may be an error.

We had this occur in a 382 unit complex my biz partner and me purchased back after Hurricane Katrina in New Orleans. The circumstance was a bit different as a break in the line occurred which resulted in damages AND a water use bill which totaled about $160K. We had to prove to the city that we didn't have any construction which may have caused the problem AND provide evidence of the bill being in the low 5 figure arena for the previous 2 years before they would relent.

Good luck and please keep us posted.

Cheers-mk

I'm calling scam or mistake.

Either way, a property lien can only be collected upon the sale of the property. Though they do have the option to make a motion to foreclose based on the lien.
