I was driving on I-10 to the casinos in Lake Charles, Louisiana and I got pulled over for doing 98 in a 70. I was just one of many drivers speeding but was the only one that got caught. Regardless, I cannot do defensive driving because I had to do it for a moving violation I got back in September 2013. I called the court to see what my options are and clerk stated that since I was in such excess of speed, I have to go to the court date and that she cannot do anything for me over the phone.
I have no problem going to the court, I just wonder if I can ask for deferred adjudication or perhaps another option to where it does not appear on my license? Before this ticket, my license is clean and I would like to keep it that way. I've read online that lawyers are pointless and expensive. Any advice would be much appreciated. |

Don't get a lawyer, their fees are probably higher than the ticket price.
Here in CT, You can ask to donate the price of the ticket to a Charity or perform Community service which removes the point from your license. So your best option now is to do the Defensive driving class again.

The fact that the clerk said there was nothing she could do for you and to show up for the court date would make ME go out and lawyer up. You may be their "big fish" of the day. You get nailed with that and it will be a big fine and ^^ insurance premiums for 39 months.

always get an attorney. sure it cost more but the chances of it not being on your record are much better. it's a bit of a gamble but worth it imo. plus you don't have to wait for everyone else to go in front of you. people with attorney's go to the front of the line.

speaking of gamble, the last time i paid for an attorney for my wife, the cop didn't show up. he was like "thanks for the loot, kid! have a nice day!"
still... i would get one every time.

If I do a lawyer, would it be wise to pursue a lawyer there locally vs here in Houston?
My lucky day would be if cop doesn't show up, but I've never had that happen in my past speeding tickets, so thats a long shot. |

One thing that a lot of people do here is reschedule the court date a couple of times. Most cops only go to court once or twice a week and schedule all of their tickets for that date so by rescheduling you increase the chances of him not being there. Schedule it near a holiday if you can for further increased odds

The officer will be notified but if it doesn't mesh with another of his days then I doubt he'll make time for it. Say he writes 100 tickets in a month and 90 of them are going to show up on the scheduled day, he probably isn't going to come in on his day off for the other 10. But I've rescheduled twice in a row before and still had him show up so there's that. Playing probability for a lazy cop basically, haha

1- goto court, maybe the cop won't show up
2- if he does show, see if the prosecutor is willing to drop the ticket to a non moving violation 3- if they don't, ask for a continuance and go find a lawyer.

That depends on whether you are going to court there or in Houston. If you are going to their court use a lawyer from that county and use a local one if you are going to court in Houston. A lawyer local to that county will have more clout in the court than one in another county.
