Broken chair part and warranty

Hello. I found this plastic part broken on the side of the driver seat and took the car to the dealer, to see if warranty covers it. Well they are not sure and have to talk to German base first but they said don't count on it.

I'd like to hear your view please. I thought the part broken during normal usage without abusing it (well I didn't let my kids or myself jumping up and down on it), and it's broken during the warranty period, BMW should cover it. It's just not a "wear and tear item," and I have not modified anything on the car, at all.

BMW here so far said they would only replace interior parts when defective parts are found during delivery. After that the user should cover it. In this case I just don't understand 'cause I only know one way of sitting on a chair
